PKSD Attorneys Recover $200,000 in Nursing Home Negligence Case

Our firm has a proven track record of fighting for the rights of victims of nursing home negligence and abuse. Three of our attorneys (Pat O’Neill, Ben Reyes and Kate Metzger) were recently able to recover a $200,000 verdict in the case of a 93-year-old nursing home resident who died after a fall caused by staff negligence.
The victim had an advanced case of dementia and had been transferred to the skilled nursing facility just 20 days prior to the fall that led to her death. The fall occurred when she tried to stand up from a wheelchair. She had fall just three days prior to this.
When the victim was admitted to the facility, she was determined to be a high fall risk and would be supervised in her room when she was eating. Our attorneys argued there was not adequate supervision in the room because there was just one aide for 10-13 residents in need of supervision.
The aide assigned to the victim’s room when the fall occurred was new. This was her first job in a health care setting and her seventh shift as a certified nursing assistant.
The victim endured three to four days of pain and suffering after the fall before a brain bleed caused her death.
Falls can be a huge risk factor for nursing home residents due to various physical and mental disabilities and limitations. This is why nursing homes need to take proper precautions to help prevent residents from falling, particularly when they have a high risk of falling. Unfortunately, understaffing is a significant problem at many nursing homes and this results in at-risk residents being unsupervised. This can increase the risk for falls that could result in severe injury.
